Terms of Service

These Terms of Service ("Terms") govern your access to and use of BidWatch (the "Service"). BidWatch is operated by 9GG LLC ("BidWatch", "we", "us"). By creating an account or using the Service you agree to these Terms.

1. The Service

BidWatch monitors public-bid and RFP portals (including SAM.gov and state, education, healthcare-facility and maritime sources), relevance-scores solicitations against the capability profile you provide, drafts first-pass response materials (cover letters and requirement-compliance matrices), and tracks deadlines and addenda. The Service is a productivity tool for bid and proposal teams.

2. Eligibility & accounts

You must be at least 18 and authorized to act for your organization. You are responsible for the accuracy of your account information and for safeguarding your credentials. You are responsible for all activity under your account.

You agree not to misuse the Service, including: reselling access without authorization; scraping or overloading the Service; reverse-engineering it; using it to violate any law, procurement rule, or third-party portal's terms; or uploading unlawful content.

5. No professional advice; your responsibility

BidWatch's relevance scores and drafted responses are an automated starting point, not legal, contractual, or bid advice. You are solely responsible for reading each solicitation in full, verifying every requirement, confirming eligibility, licensing, bonding and insurance, meeting deadlines, and for the content you submit. 6. Intellectual property

The Service, its software and content are owned by BidWatch and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain ownership of the capability profile and content you provide; you grant us a license to process it to operate the Service.

7. Third-party services & data

The Service relies on third parties (including payment, email, AI drafting, and government data sources). Public solicitation data is owned by the issuing agencies and provided on a best-effort basis; we do not guarantee its completeness, timeliness, or accuracy. 8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that you will win any bid or that the Service will surface every relevant opportunity.

9. Limitation of liability

To the maximum extent permitted by law, BidWatch will not be liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits, lost bids, or lost data. Our total aggregate liability arising out of the Service will not exceed the amounts you paid us in the 12 months preceding the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or to comply with law. On termination your right to use the Service ends; certain provisions survive.

11. Changes

We may update these Terms; material changes will be posted here with a revised "Last updated" date. Continued use after changes constitutes acceptance.

12. Governing law & contact

These Terms are governed by the laws of the jurisdiction of 9GG LLC's principal place of business, without regard to conflict-of-law rules.
